1. Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of KidPickUp (the "Service"), operated by Think X Design Media, a sole proprietorship based in British Columbia, Canada ("KidPickUp," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. These Terms apply to all users, including account owners and approved helpers. The Service is offered to users in Canada and the United States.

2. Description of the Service

KidPickUp is a coordination tool that helps adults manage children's pickup and drop-off arrangements. Features may include:

  • Schedule creation and management
  • Adding and removing trusted helpers within a family group
  • Notifications and reminders
  • In-app messaging
  • Emergency contact and family information management
  • Optional AI scheduling assistance

What the Service is not: KidPickUp does not provide transportation, emergency response, supervision, or background-check services. It is a coordination and communication tool only. We do not vet, screen, or perform background checks on helpers, and we are not responsible for the conduct of any user, helper, or third party.

3. Eligibility and Account Registration

To use KidPickUp, you must:

  • Be at least 18 years old and able to form a binding contract
  • Provide accurate and complete registration information
  • Keep your account credentials secure and confidential
  • Notify us promptly of any unauthorized access or use of your account
  • Be responsible for all activity that occurs under your account

The Service is intended for adults. It is not intended for children to use directly.

4. Helpers and Family Information

As an account owner, you decide which helpers to add to your family group and can remove them. Approved helpers may be able to view family group information such as child profiles, emergency contacts, schedules, pickup notes, and coordination data.

You are solely responsible for choosing your helpers and for deciding what information to share with them. You should add only individuals you trust with this information. Helpers agree to use family information only for coordinating pickups and drop-offs and to respect the privacy of that information.

KidPickUp does not provide child medical profiles. You must not use child profiles, pickup notes, messages, or other free-text fields to store medical or health information such as allergies, medications, diagnoses, blood type, or doctor details.

5. Safety Disclaimer

Important. KidPickUp is a coordination tool and does not perform background checks, vetting, or supervision, and is not an emergency service. You — the account owner — are solely responsible for:

  • Selecting, vetting, and approving all helpers
  • Determining that helpers are trustworthy and capable
  • Verifying the safety and suitability of any pickup or drop-off arrangement
  • Supervising and ensuring the well-being of your children
  • Contacting appropriate emergency or professional services when needed

We encourage you to independently verify references and conduct your own checks before granting anyone access to your children or your family information.

6. Subscriptions and Payments

In-App Purchases Only

Paid subscriptions to KidPickUp are sold exclusively as in-app purchases through the Apple App Store and Google Play Store. All billing is handled by Apple or Google, as applicable, and is subject to their respective terms.

Plans and Auto-Renewal

Subscriptions may be offered on a monthly or annual basis. Subscriptions are auto-renewing unless you turn off auto-renewal before the renewal deadline shown by the applicable app store. Your account will be charged through that store at the price shown for the selected plan. Cancelling normally stops the next renewal; paid access generally continues until the end of the current billing period, subject to the store's rules.

Free Trial

Where a free trial is offered, its duration, eligibility, conversion date, and price are presented at the point of purchase. Unless cancelled through the applicable app store before the trial ends, the trial may convert to a paid, auto-renewing subscription as disclosed in the purchase screen.

Cancellation, Refunds, and Pricing

You manage, cancel, or turn off auto-renewal for your subscription through your Apple or Google account settings. Cancellations, refunds, and local/regional pricing are controlled by the applicable app store and governed by its policies; we generally cannot process refunds directly. Prices displayed may vary by region and currency as determined by the app store.

Apple Standard EULA

If you download the app from the Apple App Store, your use is also subject to Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Harm, threaten, harass, or endanger others
  • Provide false, misleading, or fraudulent information
  • Access another user's account or family group without authorization
  • Interfere with, disrupt, or attempt to circumvent the Service's operation or security
  • Reverse engineer, scrape, or misuse the Service or its data
  • Use the Service for any purpose other than as intended

8. User Content and Responsibilities

You are responsible for the information you enter into the Service, including information about children, helpers, and emergency contacts, and for having the authority to provide information about other people. You represent that the information you provide is accurate and that you will keep it up to date.

9. Intellectual Property

The Service, including its software, design, content, and trademarks, is owned by Think X Design Media or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal, family-coordination purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as permitted by law or with our written permission.

10. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements. Nothing in these Terms limits any warranty or legal right that cannot be excluded under applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, KidPickUp and Think X Design Media will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, arising out of or relating to your use of the Service. To the maximum extent permitted by applicable law, our total aggregate liability for any claim relating to the Service will not exceed the amount you paid for the Service in the twelve months preceding the event giving rise to the claim. These limitations apply subject to, and do not exclude, any rights or remedies that cannot be limited or excluded under applicable law.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless KidPickUp and Think X Design Media from claims, damages, losses, and reasonable expenses arising out of your use of the Service, your content, your selection or supervision of helpers, or your violation of these Terms or the rights of any third party.

13. Termination

You may stop using the Service and delete your account at any time through the app. We may suspend or terminate your access to the Service if you violate these Terms or where reasonably necessary to protect the Service or its users. Provisions that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as through the app or by email. Your continued use of the Service after an update takes effect indicates that you have reviewed the current version.

15. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-law principles. Nothing in this section removes or limits any mandatory consumer-protection rights or remedies available to you under the laws of your place of residence, including applicable consumer laws in Canada or the United States, that cannot be waived by agreement.
